Terms of Service

1. Your Account

• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account credentials
• You may not create multiple accounts or use automated means to access the service
• You must be at least 13 years old to use NoteNest

2. Subscriptions and Billing

NoteNest offers subscription plans that unlock premium features:

• NoteNest Lite: $4.99/month
• NoteNest Pro: $9.99/month or $71.99/year
• NoteNest Elite: $14.99/month
• NoteNest Founder: $6.99/month (limited availability)

Prices may vary by region and are subject to change. Current pricing is always displayed in the App before purchase.

Payment

Payment will be charged to your Apple ID account at confirmation of purchase. All payments are processed by Apple. We do not collect or store your payment information.

Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.

Price Changes

Subscription prices may change. If the price increases, you will be notified in advance and must agree to the new price to continue your subscription.

3. Free Trials

If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless you cancel at least 24 hours before the trial ends. The duration of the free trial will be specified at the time of offer.

Any unused portion of a free trial period will be forfeited when you purchase a subscription.

4. Cancellation

You can cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. You retain access to premium features until then.

5. Refunds

All purchases are processed by Apple. To request a refund, visit reportaproblem.apple.com. We cannot process refunds directly.

6. Your Content

• You retain full ownership of all notes, documents, and materials you create in NoteNest
• You grant NoteNest a limited license to process your content solely to provide app features (AI summaries, diagrams, study tools, etc.)
• We do not use your content to train AI models
• We do not sell, share, or distribute your content to third parties
• You can delete your content at any time by removing notes within the app or deleting your account

7. AI Features

NoteNest uses artificial intelligence to provide study assistance including:

• Note summaries and concept breakdowns
• Auto-generated diagrams and flowcharts
• AI Tutor conversations
• Exam preparation materials
• Study plan recommendations

AI-generated content is provided as a study aid and should not be treated as authoritative academic material. You are responsible for verifying AI-generated content for accuracy.

8. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Upload malicious content, malware, or harmful code
• Attempt to reverse engineer or decompile the App
• Circumvent subscription or access controls
• Infringe on any intellectual property rights
• Use the App to harass, abuse, or harm others
• Create accounts through automated means

9. Intellectual Property

NoteNest, its design, features, and code are the intellectual property of NoteNest. You may not copy, modify, distribute, or create derivative works based on the App without our written consent.

10. Termination

We may suspend or terminate your access to the App at any time, without prior notice, for violation of these Terms or for any reason at our sole discretion. Upon termination:

• Your right to use the App ceases immediately
• Active subscriptions are not automatically refunded (see Refunds section)
• Your locally stored data remains on your device

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:

• The App will be uninterrupted or error-free
• AI-generated content will be accurate or complete
• The App will meet your specific requirements

12. Limitation of Liability

To the maximum extent permitted by law, NoteNest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, academic outcomes, or revenue, arising from your use of the App.

13. Apple-Specific Terms

• These Terms are between you and NoteNest, not Apple Inc.
• Apple has no obligation to provide maintenance, support, or warranty services for the App
• In the event of any third-party intellectual property claim, NoteNest, not Apple, is responsible for investigation and resolution
• Apple and its subsidiaries are third-party beneficiaries of these Terms

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law provisions.
